DMCA Policy

HappyGamer, Inc. (“HappyGamer”) provides the Site as a blogging community for gamers to share gaming news, game reviews, gaming guides, commentary and journalism about gaming, game developers and gaming industry. As such, users and their content are the backbone of the Site. We take intellectual property ownership seriously at HappyGamer and strive to provide the Site as a resource for the gaming community.

This page explains how we handle submissions and “takedowns” under the Digital Millennium Copyright Act (“DMCA”).

The process begins with a copyright holder (or agent on their behalf) submitting a Takedown Notice to our mailing address.

After receiving Notice, we will review the Notice and based on that review, HappyGamer may choose to remove the content alleged to be infringing, either in whole or in part, as the case may be.

We update the requesting party as to the action taken by HappyGamer. We also notify the user of our action.  We make a note on the user’s account of the action taken.

Before submitting a DMCA Takedown Notice, please consider whether the content falls under the fair use provision(s) of the applicable copyright laws.

The DMCA safe harbor provisions require website operators to include in its policy a system to suspend accounts of repeat offenders. HappyGamer has adopted and implemented a policy that provides for the termination of users who are repeat infringers. Users who have been notified of infringing activity more than twice and/or had their submission removed from the Site more than twice will be suspended.

We believe we respect copyright holders with valid claims while providing our Site for users to create commentary and journalistic content relevant to gaming and gaming industry.

  • Address, City, State, Zip and Country
  • Phonenumber and Email address
  • Name of Copyright Holder
  • URL (permalink) to alleged unauthorized content on the Site
  • Description of the copyrighted work
  • Location of original copyrighted work (not from the Site)
  • Signature of copyright holder or authorized agent

By providing this information, you certify that you believe you have a good faith belief that the copyrighted content described above as allegedly infringing is not authorized by the copyright owner, its agent or otherwise by law.

By providing this information you further certify that your information is accurate, and you are authorized to act on behalf of the Copyright Owner.

By providing this information, you understand, acknowledge and agree to us sharing this information, and any subsequent information provided by you to the user who uploaded the content at issue.
