With these laws, any decision of playing pirated games will impose a very large… big stick in the hands of the jailbreaking crowd.

The real kicker: Nintendo had added those lines as a sneaky update to the legal papers, and somewhere deep within that boring text lies a very simple threat to anyone even thinking of hacking his next-gen box. The policy simply says they can “disable” tampered devices, theoretically translating to a really expensive paperweight for your new Switch 2, with no warning or forgiveness—just bricked.

Well, technically speaking, it isn’t ever-new for Nintendo. They have been attacking these piracy folks since forever—starting with suing ROM sites, to patching exploits in early days of Switches. But this? This spells relentless indeed. Not just turn yourself from playing online anymore-a kind of ban that they already do-beyond every bit of online can be killed eradicated.

And yep, they probably can find out if you’ve done it. Right now, Switch has a kind of telemetry going back to Nintendo. You can also bet Switch 2 is going to carry a whole ton of anti-tampering tricks.

Within the fan community, the reaction is mixed. Some cheer it on saying, “Finally! Now this will put an end to pirates ruining online play and stealing games.” Others? Well, to put it mildly, the homebrew community isn’t very happy about this. Modders thrive on tinkering with their consoles for things like emulators, custom themes, and a ton of unofficial goodness.
